Be’er Sheva district court judge Yisrael Pablo Axelrod on Sunday rejected the petition to release Meir Ettinger from his administrative detention for several hours on Monday so as to attend the brit milah (circumcision) of his firstborn son.
Ettinger has been held for the past eight months without trial or charges against him on administrative orders, a relic from the British Mandate which has almost exclusively been used against Arab terror suspects.
The Israeli Security Agency (ISA) and the Israel Prison Services (IPS) opposed Ettinger’s release for the brit, even if he was accompanied by prison guards which is a measure common even among prisoners who are accused or convicted of serious crimes, such as those serving life sentences for murder.
By contrast, Ettinger is being imprisoned in extreme conditions of solitary confinement and is not being allowed any phone calls except to several close family members, even though there has been no evidence or indictment presented against him for any crime.
IPS authorities proposed having the brit milah held in the prison, instead of approving the common step of letting Ettinger out under guard.
Attorney Sima Kochav of the Honenu legal aid organization, who submitted the petition to have Ettinger let out for the brit last Thursday and is representing him, said the group intends to petition the Be’er Sheva court’s decision to the Supreme Court.
“We regret the decision and are disappointed by it,” said Kochav. “There are really hard feelings here that the sources tasked with approving the release did not act with clean hands, and they are pursuing Meir Ettinger.”
“It is important to emphasize that this is an administrative detainee and not a criminal prisoner,” she added.
“Dangerous criminal prisoners go out on vacations and Meir Ettinger is behind lock and key without an indictment submitted against him, only for his ideological positions and not for a specific danger he poses, and therefore there is no reason to prevent his release to the brit milah.”
On Saturday night around 30 of Ettinger’s family members protested at the iconic Chords Bridge in Jerusalem, demanding that he be let out for the brit.

NO!!!! They are guilty of much worse. They publicly declared the soldiers guilt prior to an investigation and thus abused their high office. Their public declaration had the defacto effect of influencing their military subordinates investigating and prosecuting the canard. They sought to instruct their subordinates to illegally give them their desired outcome. They abandoned and betrayed the soldier and in effect betrayed the trust of all the soldiers placed in their care and under their command.
Anyone who believes that they acted ignorantly or in error is nuts. I have never heard of commanders abandoning and betraying their soldiers in such a transparent and obvious manner and yet Israelis dont demand their resignation, arrest, indictment and trial for this and the Duma event. What reason is given by the judge or should we just assume it is orders from on high.. from Yaalon and his boss BB? The same orders from high have been given on the soldier that Yaalon accused of murder before an investigation began.
Yaalon should be sent for a psychological evaluation to determine why he compulsively jumps up to accuse jews of murder and baby burning in what appears now to be a serial behavior. Administrative detention is used in many cases against Arab terrorists where the Shin Bet does not want to expose agents or informants. If they were exposed it would result in their deaths.
This an effective tool in the on going war and preserves the ability to reduce terrorism. This war against the Palestinians must not be weakened even more.
Israel should simply take this tool off the table for Jews.

Administrative Detention Weakens Israeli Democracy so we must remove it from our tool-box in fighting Arab Terror. It’s counter productive and now used against it’s original intent to deter Arab terror but now and for some time being used politically and physically to persecute Jews.
Israel maintains a perpetual state of emergency as a political tool to provide the legal rationale, however twisted, for the policy of continuing administrative detention.
Israel has stitched together a complex system of various emergency measures borrowed from the British mandate era, Jordanian rule over the territories, and its own military and civilian laws, while making no effort for nearly seven decades to unify these legal procedures.
Successive Israeli governments maintained this hodgepodge administrative detention system to give it the flexibility to resort to one set of rules or another to enforce detention under the guise of legality.
Admin detention has been maintained primarily as a tool against Arab unrest and terror where there is no proof of wrong doing but mostly where intentions are believed clear to those upholding and enforcing national security. It’s use against nationalist motivated Jewish activists goes against the intent of these regulations and has become a very dangerous practice to those who advocate civil rights and democracy and the rule of law.
The Israeli government has cut the rug out from their justification for maintaining the regulations that allow administrative detention when it is used as a political tool to persecute Jews who pose no threat to national security which is the case with Ettinger and many before him over the years…. That he is part of the Kahane family seems to be reason enough for our stupid never have a clue anti Jewish clique of police, Shin Bet,State Prosecutors and courts…
They are all corrupt, all against Jewish nationalism. For these protectors of their kind of Israel, nothing is sacrosanct like human rights, civil rights and democratic principles of jurisprudence. Nothing will deter their visceral hatred if not fear of ideologically and religiously motivated young Jews who are viewed by them as being more dangerous to their vision of the state than are Arab terrorists.
Anyone who is familiar with Israel’s state of being from the day of its inception to the present cannot deny the fact that the country has legitimate national security concerns. But when national security becomes a political tool It should be reviewed and abolished.
Palestinian lawyer Mohamed Allan, who went on a hunger strike for 65 days to protest his indefinite detention in Israeli custody, was subsequently moved into medical care and had his detention suspended in August over fears that he might die in prison — potentially provoking massive Palestinian unrest. I think that the fear of provoking widespread Pali unrest in that case won his release from admin detention.
There is a lesson here for Jews. Let’s get rid of Admin detention as it is besides being draconian and ineffective in deterring terror it is also undemocratic and being used by unscrupulous state interests in persecuting Jews.
