Sidney Powell gets expedited appeal in Georgia Dominion case

by Spencer Neale, WASH EXAMINER |  | December 02, 2020 06:35 PM

A federal appeals court in Georgia will hear an expedited appeal of former Trump campaign lawyer Sidney Powell’s request to gain a temporary restraining order forcing audits and a forensic examination of Dominion voting machines used by the state in the 2020 election.

Dominion is a voting-machine manufacturer, and its products have been alleged to be used as part of a widespread scheme to defraud President Trump of the 2020 election in several key battleground states, including Georgia.

Joe Biden won Georgia by more than 16,000 votes and claimed the state’s 16 electoral votes, which were essential to him claiming victory over Trump, according to the Associated Press.

  1. @ peloni1986:
Hi, peloni. Thank you for your very informative post. I had to look up the word “feckless”, to find its precise origin. It comes from a Medieval Scots word, “feck”, which is equivalent to the modern English “effect”. You were thus describing the GA republican State legislators as “ineffective”. Let’s hope Sidney is able to convince the SCOTUS enough for them to zap the Georgia Reps in the right places and make them “effective”.

Things are beginning to look very hopeful for Team Trump.

  2. @ Michael S:
    Hi Michael,
Regarding the Sidney Powell approach, it is not actually a criminal track. It is in fact, a civil litigation much as Giuliani’s.

Giuliani, with the President as a client, is focused on showing that a number of ballots (far exceeding Biden’s lead in each state) should be set aside. In so doing, he would show that there is a preponderance of evidence that Biden did, in fact, not necessarily win the election due to irregularities. Many if not most of these irregularities can be attributed to Biden supporters and as a consequence would be interpreted in a legal setting as being counted against Biden’s #’s. This will lay open an argument to put before the Republican legislatures and/or the US Supreme Court that Trump should be named the winner for each state. Giuliani has started his legal track in the State courts due to his focus on contesting the election results.

Powell’s track is actually also a civil litigation, as she is not a gov’t official she can not prosecute criminal charges. Her clients are as she states it, the American People. More specifically, she is representing individuals who would have been named Members to the Electoral College. Powell is charging the State reps as being responsible for and complicit in conducting a fraudulent election, by either intent or neglect. The burden of proof is still just the preponderance of the evidence. Powell is intent on displaying every level of fraud and chicanery for which she can provide evidence – including the Hugo Chavez angle. And she is not shy about possibly implicating the involvement of Republicans in the fraudulent activities, “letting the chips fall as they may” as she said. She is pursuing a law suit of fraud in Federal court citing federal statutes that have been violated.

These are the two tracks, as best I see it. They are each aimed at overturning the election in an expedited basis to appear before the US Supreme Court. Along the way each track is being countered by the Democrats as they attempt to join each defendants’ case – as they have better lawyers and more money and a strong vested interest in the outcome. The Democrats need only to delay it long enough to frustrate the Giuliani/Powell tracks from achieving a ruling from the Supreme court or a favorable consensus by the usually feckless State legislators.

Your synopsis otherwise is quite accurate and complete.

  3. @ Michael S:
One of the Senators in GA, Johnny Isakson became ill and had to resign. Gov. Kemp named Kelly Lafleur to replace him until the next election which is this year. Perdue is running b/c he finished his previous term and is running as per usual for reelection.

  4. @ peloni1986:
Hi, peloni. I’m not trolling you, in case you’ve wondered. I just noticed that you’re the first of the responders to comment specifically on the GA situation.

I just finished listening to the tail end of the GA State Senate Judicial Subcommittee hearing:

    https://www.11alive.com/article/news/politics/elections/georgia-state-senate-election-hearings/85-8dee5864-c6ad-4a02-87e3-cdc63567ea68

My takeaway on it, is that the state senators have been getting deluged with constituent complaints about the election fraud.[1][2], but that they don’t plan to do a damned thing about it.

[1] Twitter denies any fraud anywhere, ever.
    [2] Twitter is total BS

Donald Trump’s team seems to be pursuing two parallel tracks:

    1. Sidney Powell’s and others’ criminal tracks, which have a high bar of evidence and may not hit their mark for a long time, and

    2. Giuliani’s civil suit track, which has a lower bar of evidence and may lead to a timely hearing by the US Supreme Court.

Along with both tracks, there is an attempt to expose evidence to the public, inducing them to attend rallies, call their legislators (State and Federal) and provoke the state legislatures to action to certify Trump electors.

The coming US Senator elections in Georgia frankly confuse me. To my understanding, US senators run for office once every six years, on overlapping schedules. I don’t understand why Georgia plans to elect TWO senators in January. I need to do more research…

  5. @ Adam Dalgliesh:

Yes I agree. He prefaced, and the Headlines said, that “this is probably the most important speech I’ve ever made”.. I listened to every word of it last evening. on Youtube.

Adam …and OTHERS,… You should really tune in to E&R Legal Group rundown, every day at 4 p.m. on youtube. He goes through every important document, and filing of each hearing and explains the implications of everything , sometime a little too much, but right for the ordinary viewer. VERY informative and helpful.

  6. President Donald Trump’s arsenal for overturning the election will soon be down to one final, possible maneuver: pressing his Republican allies on Capitol Hill to step in and derail Joe Biden’s presidency.

Although the Electoral College casts the official vote for president on Dec. 14, it’s up to Congress to certify the results a few weeks later. And federal law gives individual members of the House and Senate the power to challenge the results from the floor — a rarely used mechanism meant to be the last of all last resorts to safeguard an election.

But several House Republican lawmakers and aides now tell POLITICO they’re considering this option to aid Trump’s quest.

“Nothing is off the table,” said Rep. Matt Gaetz (R-Fla.).

Gaetz pointed out that in January 2017, a handful of House Democrats took this precise procedural step before their efforts flamed out during a joint session of Congress presided over by none other than Biden, then the outgoing vice president.

  7. For goodness sake, Ted, please get the complete 45-minute video of Trump’s speech. Amazingly, non of the conservative news sites have broadcast the speech in fall. Newsmax TV,, for example, broadcast only a 30-second or less clip from it. And only the briefest notice of it in the Print section of the online newspaper. The last I checked, Breitbart had only a brief mention in print and no video. Gateway Pundit had nothing about it. World Net Daily did slightly better, with maybe 5 minutes of exerpts. Fox news broadcast maybe a two minute clip from the speech, plus a four minute commentary by its reporters claiming that there was “no evidence” to support his very detailed claims of fraud, and noting that Attorney General Barr has denied them.

I didn’t bother to check the “liberal” hatemongering stations.

The only news service that did broadcast the full, unedited speech was Arutz Sheva, which in the U.S. is considered a “foreign” station.

  8. A significant number of “important” fake republicans are crypto-elitists and have been on the side of the dems for several decades! It is about POWER!
This why 74+ millions have voted for Trump.

  9. The Democrats and GA republicans are doing a good job in their delaying tactics, blocking any in court discussion of the frauds and any analysis of the evidence that they claim doesn’t exist. But with Bush v. Gore, remember that the only case that Bush won was with the Supreme Court. Trump will win or lose in the Supreme Court – unless the spineless Republican state legislators in the various states step up and conduct their own investigations. Many of them are having hearings now, hopefully it will come to more than that. I am encouraged by the finding of 3% error in the 100 ballots inspected in AZ…Let’s hope either the Supreme Court or the state legislators don’t let us down. But we still have time…Trump suggested he could continue contesting results thru early January in an interview. I am hoping for something much sooner than that…

  10. https://www.israelnationalnews.com/News/News.aspx/292436 Trump has just broadcast an exiting speech from the White House outling the voter fraud that has taken place in great detail and affirming his belief that he is the actual winner of the election. Also, outlining the corruption of Democratic machine politics in America, and the relentless persecution to which he has been subjected ever since he first announced his candidacy for the Presidency. A must see!

  11. . Is this too little too late? Trump has to win this one and having won it, opened up the floodgates for appeal wins in several other battleground states given to Biden.
Something has got to give. IMO and soon.
