Update on the massive civil lawsuit filed by over 100 Israeli victims from October 7 against UNRWA: the case is currently awaiting another position paper from the @realDonaldTrump administration, which has requested an extension of time to evaluate its position on this matter. Previous position paper submitted by the Biden administration fully supported the UN’s stance that UNRWA has complete immunity from lawsuits.
The plaintiffs argue that such claimed immunity does not exist in cases of crimes against humanity, as occurred here, and even if it did, it should not be upheld.
The plaintiffs assert that beyond substantial evidence of UNRWA employees’ active participation in the genocidal attack and the abduction of innocent people, the UNRWA headquarters in New York has also been actively and systematically involved in supporting Hamas activities—including the construction of tunnels beneath the organization’s buildings, the incorporation of murderous jihadist ideology into educational curricula, and a financial mechanism for laundering cash that was transferred to UNRWA for humanitarian assistance but was, in fact, diverted to Hamas for the purchase of weapons and other terror means.
While it should be obvious to all of us which result will be chosen, the final straw that breaks the camel’s back will be to present this issue to the General Assembly at the UN. On the other hand, which court can actually preside over a case like this?
