Lower threshold for incitement to terrorism convictions passes Knesset vote

New Bill creates a seperate, easier-to-prosecute crime of incitement to terrorism, as opposed to general incitement to violence, passed its first reading in the Knesset on Monday.

The penal code currently establishes that incitement to violence or terrorism, which carries a five-year prison sentence, is when someone publicizes a call to an act of violence or terrorism, or praises, sympathizes with or encourages such acts, and the statements have a real chance of causing someone to behave violently or commit an act of terrorism.

The new bill creates a separate crime of incitement to terrorism, which would not require the prosecution to prove the probability of the statements causing someone to commit an act of terrorism.

In addition, the bill states that writing about “a correct and fair account” of the incitement is not a punishable offense.

The bill passed a first reading with 34 in favor and nine opposed, and will go to the Knesset Constitution, Law and Justice Committee to be prepared for a second and third (final) reading.

MK Youssef Jabareen (Joint List) lamented that “the government is eating away at the democratic principles that we were accustomed to until now. This proposal violates the historic balance between criminal laws and freedom of expression and damage the country wants to prevent. I am concerned about this law being used inappropriately.”

Joint List MK Jamal Zahalka said of other MKs in the plenum that “no one dares to argue against [the bill], because they will be accused of being unpatriotic.”

MK Yoel Hasson (Zionist Union), however, called the bill important, and said to MK Bassel Ghattas (Joint List) who was in the plenum at the time, that he will be the first person to be put on trial under the new law.

“The problem isn’t incitement, it’s that there is no way out for the Palestinians,” MK Nachman Shai (Zionist Union) argued, though he still supported the bill.

    The UNRWA, its leadership, board, teachers and officials should be prosecuted in Israel for this criminal behavior and incarcerated. It is absurd that Netanyahu allows such a situation to continue… the schools must be supervised and all such books and curriculum removed, or shut them permanently down. Jail those bastards from the UNRWA. I blame BB for allowing these thngs to continue.

    NO wonder there is terror as it begins in the UN schools funded by the UN and the EU. Any school in israel teaching anti semitism or terror should be mandatory and immediately closed and those responsible arrested. I would like to see the foreign UN officials jailed. the fault is BB for allowing it all to continue for so many years.

    All schools in Israel controlled areas should fall under the supervision of the Israeli Minister of education, inc the UNRWA schools. This is why anti semitic incitement requires deportation, and take the stinking euros with them.

  5. Israel needs a set of laws specifically targeted towards anti semitism and anti semites. general laws against terror are not enough. These laws need to give attention to the 2000 year MO of the tactic and strategy of libeleing Jews in order to incite their murder and swindling. the link between the libeling of Jews and murder, pogrom and holocaust cannot be ignored. The libeleing of the state of Israel and Jews should be recognized as being de facto evidence of incitement to murder and pogrom. Pogrom, murder and shoah have always been preceeded by lies and libels. if one cannot prove their lie or libel then they should be automatically co convicted of an anti semitic libel charge which automatically assumes the intention to incitement to murder and terror. a state of Jews which does not criminalize anti semitic libels is an ostrich. The criminalization should include mandatory and automatic deportation. This will at the same time rid the nation of the anti semitic MK’s in the Knesset. It cannot be considered racist or islamophobic as it relates to their specific behaviors not their origins. It also cannot be considered and infringement of speech as lies and libels are never legally considered acceptable free speech. It merely makes anti semitic libel a heinous crime rather than a normal acceptable MO as exists now. This is the legal attack which will protect Jews. This would also make euro libelers who enter Israel subject to arrest and/or deny entry.
