  1. It would not be either legal or politically possible for Trump to impose the insurrection act on the entire country unless there was an actual armed insurrection on a nationwide basis. The army chiefs have made it clear in congressional testimony that they would never enforce such a decree. The courts would immediately declare it illegal. The move would also be extremely unpopular, and would completely discredit Trump in the eyes of most citizens, making him appear both impotent and with dictatorial ambitions.

    However . . . Trump could certainly declare martial law in Portland, where the local government has proven itself unable to restore order and end the insurrection there, which has been going on continuously for months. He could cite not only the insurrection act, but numerous other Federal statutes as well to justify this action.

    This would probably provoke massive riots in other cities, including Atlanta, Louisville, Richmond, Minneapolis, Washington DC, New York, Philadelphia, Chicago, Los Angeles and San Francisco. Trump could then lawfully declare martial law and federalize the national guard (which would probably prove more loyal than the army) in those cities as well. Once martial law was imposed, these cities might prove more amenable to a genuine audit of their voting machines, which in turn could persuade Congress to recognize Trump as the winner in those states.

    Unfortunately, Trump won’t do this, because he is a” softee” who hates violence and always forgives his enemies, in deed if not in words. He hates to cause harm to any innocent, or even guilty person, even when he has the legal right to do so. And of course there are some innocent people even in Portland.
