ICC prosecutor ordered to reexamine deadly Gaza flotilla incident

Appellate judges in the Hague reject Fatou Bensouda’s decision to close case into IDF’s 2010 takeover of Mavi Marmara, in which 10 violent pro-Hamas activists were killed

THE HAGUE, Netherlands (AP) — Appeals judges on Monday ordered the International Criminal Court’s prosecutor to reconsider again her refusal to open a formal investigation into the 2010 storming by Israeli forces of a blockade-busting flotilla heading to the Gaza strip.

Presiding Judge Solomy Bossa ordered prosecutor Fatou Bensouda to decide by December 2 whether or not to open a formal probe. The 3-2 majority ruling by the court’s appeals chamber is the latest step in a long legal battle to bring the case before the court.

Bensouda earlier declined a request by the Indian Ocean island nation of Comoros to investigate the May 31, 2010, takeover of a vessel in the flotilla, which was sailing under a Comoros flag.investigation.

In her initial refusal to open a full-scale investigation, Bensouda acknowledged that war crimes may have been committed on the Mavi Marmara ship, where Israeli commandos boarded the ship and were met with violence, and in the ensuing melee 10 Turkish activists belonging to the pro-Hamas IHH group were killed and several other pro-Palestinian activists were wounded. Several of the Israeli soldiers were also wounded. But she decided that the case wasn’t serious enough to merit an ICC probe.

Comoros appealed that decision and sought a judicial review when Bensouda once again refused to investigate the case.

The ICC was set up as a court of last resort intended to prosecute senior leaders allegedly responsible for grave crimes including genocide, war crimes and crimes against humanity when national courts prove unable or unwilling to take on such cases.

The appeals panel on Monday criticized Bensouda for her rejection of calls by a lower panel of judges to reconsider the case.

“The appeals chamber also finds that the unfortunate language used by the prosecutor to express her disagreement demonstrates that she was entirely misinformed as to what was required of her in conducting the requested reconsideration,” Bossa said.

Several Israeli agencies combined to bring an injured cat to Israel for life-saving medical treatment. Israel’s government CLA and COGAT government organizations, which are entirely devoted to giving humanitarian aid to Gaza, Judea and Samaria, earlier brought an injured parrot to Israel for vetinary treatment. Amazing that a country that is so loving and caring that it even saves the lives of “enemy” pets, at great expense and with hundreds of people assisting, is accused of “crimes against humanity.” We live in a perverted world.

  2. Nobody seems to remember that the IDF originally boarded the illegal blockade-breaker armed with PAINTBALL GUNS,… utterly harmless and non threatening…..until attacked by the Mamzerim with lethal intent and weapons of assault….!!

    Was not BARAK,that magnificent political genius the Defence Minister????…, who is now the leader of another attempt to subvert the will of the people…. I think the C of Staff at the time was the great soldier Gabi Ashkenazi, who is now trying to take over Israel, I hope with far less success even than that Mutt and Jeff stupidity of the Mavi Marmara, in which he was the chief “mover” and “planner”.

    Could the Israeli voters, even in their wildest nightmares , be thinking of giving the governance of their country to these blockheads…….??? It seems not possible ……….even for (political) fever-ridden Jews.

  3. Seems like the appellate judges really want a trial to adjudicate Israel’s role in the matter. They want blood. This is more than judicial activism. It is called a linching.

  4. In other words “guilty, guilty, guilty.” Possibly she can open a case against Comoros and Turkey for violation of Israel’s sea borders and intentions as acts of war.
