Responding to the High Court decision in an interview with Army Radio, Zoabi said although she respects the High Court decision, it doesn’t mean Israel is “100% democratic.”
“This ruling proves again that the Central Elections Committee is a political body that abuses its authorities and allows politicians to bar their rivals for ideological reasons,” Zoabi said.
Zoabi added she was convinced she would be allowed to run. “It was clear to me that there was no legal basis to ban me,” she said.
“However, this decision does not erase the threats, the de-legitimization, and the physical and verbal violence that I experienced at Knesset and outside of it in the past three years,” she added.
Zoabi was also determined to continue acting the way she has done thus far. “Balad and I would not allow anyone in Knesset or outside of it to define to us and to the Arab public what our legitimate positions are and what are the limits of our political activity.”
Zoabi’s attorney Hassan Jabareen claimed Zoabi’s participation in the 2010 Gaza flotilla aboard the Mavi Marmara was “a legitimate political action done by an MK that is protesting the blockade [on Gaza].”
Arguing to reinstate Zoabi, Jabareen told the justices that court precedent is clear that disqualifying a candidate for Knesset for involvement in “armed conflict” against Israel means physical armed conflict, and not just happening to be present on a vessel where armed conflict occurred with a small number of passengers.
He noted that no criminal complaint were filed against Zoabi for her mere presence on the Marvi Marmara.
Zoabi was disqualified by the Central Elections Committeelast week, in a 19-9 vote, despite Attorney-General Yehuda Weinstein recommending that she be allowed to run. The committee approved the ban on the grounds that Zoabi supported terrorism and rejected Israel as a Jewish and democratic state.
Likud responded to the decision, saying it is clear the existing law “has to change” and state “unequivocally that any expression of support for terrorism amongst candidates will result in their disqualification from the Knesset.”
MK Yariv Levin said the decision is a “scandal,” adding that it exposes Knesset and the IDF to terror.
MK Danny Danon, who petitioned the Election Committee asking to disqualify Zoabi, said following the Court ruling that he thinks “Zoabi belongs in jail.”
“The court decided to back the Marmara terrorist (Zoabi) instead of the Navy soldiers that were attacked with knives and clubs by the IHH terrorists,” he said.
Balad chairman Jamal Zahalka had said following the decision last week that if Zoabi is disqualified, Balad would not run.

Apparantly a traitorous Arab like Zoabi is better than a Jewish rabbi who loved Israel with all his heart. Kahane was kicked out for his “radical” ideals, based on Torah, but this woman, who fraternizes with terrorists, gets to stay. Something is radically wrong here. If you want to read the decision of the court do your own research. We are not here to satisfy your personal curiosity. We Israelis in such cases could give a flying shit what the court said because if such a court could twist the intent of the legislature to fit their agenda it is reasonable to conclude that another court with a different agenda might rule in accordance of the intent of the legislature and if there is any doubts to ask the legislature what was their intent when writing and enacting the Law.
Our basic Law stipulates that Judges are appointed for life with mandatory retirement at age 70-75 I forget which but that law can be changed and in view of what we now have I am for changing the Law. I would add that any decision where a judge rules against the Jewish character of the State and or it’s Zionist ethos should be automatically removed from the bench and disbarred for life from practicing the Law in any form including teaching Law in the State of Israel. I would create an elected review board who would not only review all cases and decisions of the court but act on public complaints.

The writer simply concluded there was a disconnect between the court and populist Israeli opinion and that he was surprised not one judge went along with where the public is at on the issue.
In other words, the writer has not explained the legal basis and reasoning for the court’s decision.
Xlucid may be correct about what the basic law holds, but is only surmising that the court without legal justification, ignored or rejected that law.
I am still left to wonder as to the legal prinicple and analytical basis the court stated it had to decide as it did.

They may have a problem for if a ruling today negates past rulings every case effected by past ruling might have to be reviewed and reversed. That could open up a can of worms, discredit the court and even making them appear to be a sick joke in the eyes of the public and especially peer review in the enlightened West. Our court plays to the Gallery of their peers in the West less so in Israel.

Article 7A of the Basic Law with respect to the eligibility of the deputies in the Knesset provides the following:
“7A. A candidates’ list shall not participate in elections to the Knesset if its objects or actions, expressly or by implication, include one of the following:
(1) negation of the existence of the State of Israel as the state of the Jewish people;
(2) negation of the democratic character of the State;
(3) incitement to racism.”
From the foregoing provisions, one can only deduct that the arab “deputies” of the Knesset of Hadach, Balad and Ra’am Tal parties are all ineligible and therefore illegal.
When a court does not enforce its own basic laws especially against traitors (ie Zoabi, Tibi, and co), but uses the same laws in the bad way to cause prejudice and harm the true patriots, then said court has nothing to do with a supreme jurisdiction but rather with unethical and unscrupulous ruling, and borderline treason.

The court banned Kahane’s party while allowing Haneen Zoabi to run for the Knesset. If the decision came down to having a basis in Israeli law, then either both would be banned or both would be allowed to run. It is quite clear that the decision was indeed based on ideology in both cases.

The SC in Israel is an enemy 5th column and should be viewed and treated as such. Their power can be limited and reduced by legislation and making each stand for elections with term limits.
