Beneisch should let the market decide the wage.

I posted Steven Plaut’s article under the title Beneisch shows how left wing she is. I have reconsidered.

He wrote:

    But even worse, for all intents and purposes it overrides the fundamental principle of all democracies that one is innocent until proven guilty. Beinisch’s latest venture into judicial activism is to reverse that principle when it comes to women claiming to be victims of discrimination. Henceforth in Israel employers will be presumed guilty unless they can prove that they are innocent whenever any woman can be found who drew a salary less than any man.

First of all we are not dealing with criminal law. Secondly, in many cases in the civil world, when one party makes a prima facia case the burden of proof shifts to the other side. No biggy.

In no way is this an act of sabotage of Israeli democracy as he alledged.

What it is, is an interference in the market place. Pure socialism. Plaut correctly notes how difficult it would be for an employer to prove his case. For that matter it would be difficult for an employee to prove his or her case.

The best option is to let the market dictate. Wages will be determined by supply and demand. The cream always rises.

    Isn’t this what Steven Plaut was essentially saying?

  2. Steve Plaut does highligh what is one of Israel’s biggest problems. That of being a krinocracy (rule by judges).

    Part of the reason that Bibi and so many other Israeli leaders act frustratingly as wimps is because the attorney general threatens and more than threatens to prosecute right leaning politicians for corruption if they don’t tow the political line.

    Israel’s judiciary will have to be changed from top to bottom in order for it not to get completely out of hand as it does.
