Brazil court rejects Bolsonaro party complaint over vote

“The court said the complaint was made “in bad faith” and fined the party 22.9m reais (£3.5m; $4.3m).

Brazilian President Jair Bolsonaro is challenging his election loss last month to leftist rival Luiz Inacio Lula da Silva, arguing in a complaint that votes from most electronic voting machines should be “invalidated” due to a software bug.

Bolsonaro’s right-wing electoral coalition filed the complaint in Brazil’s federal electoral court (TSE) after its audit of the vote count found  “irreparable non-compliance due to malfunction” in older voting machines.

“There were signs of serious failures that generate uncertainties and make it impossible to validate the results generated” in several older models of the voting machines, Bolsonaro’s allies said in their complaint. As a result, they urged that the votes from those models should be “invalidated.”

Valdemar Costa Neto, President of Bolsonaro’s PL party, and an auditor hired by the party told reporters in Brasilia that their audit found all machines dating from 2009, 2010, 2011, 2013 and 2015—about 59 percent of the total used in the Oct. 30 runoff— lacked individual identification numbers in internal logs, and should be voided.


Da Silva appeared to win the second round of voting on October 30, 2022, spurring massive protests throughout the country.

    What is Article 142? The lying New York Times explains:

    Many of the protesters said their demands for intervention were supported by Article 142 of the Brazilian Constitution, which says that the military has the role of “guaranteeing constitutional powers” under the “supreme authority of the president.”

    The title presumes a lot, but it is what people on the street are calling for, and the recent statement by the military leadership was far from subtle in their opposition to the election theft, so we will have to see what they will decide.

  2. The Former President & Co-founder of the Market-Liberal NOVO Party João Amoêdo, who represented the Liberal wing from it, announces, via his official account on twitter, his resignation from the party.

    Among the reasons why he resigned, he says that:
    — The NOVO Party that he created “no longer exists”
    — According to him, under the current management, the party “has been disfigured and distanced itself from its original conception” (a Social-Liberal & Market Liberal party)
    — He accuses the Party leadership of “failing to comply with its own statute”, of “silencing affiliates” and “changing the Ethics Committee” to “serve [Althought not namely] Bolsonaro-tied parties” and, above all, ATTACKING the powers of the Republic and ATTACKING democracy
    — He also accuses the party of “silencing dissenting voices” within the party, saying that the party no longer represents him and his ideals

    However, Mr. Amoedo says that his departure from NOVO party in “no way changes his desire to help Brazil”.

    Yes, they do have a massive problem and the army has expressed the view that if Bolsonaro is not left in power, they are facing a judicial dictatorship. The army having taken such a public stand begs the question of what are they going to do? Will they leave the fraudulently elected govt in place or will they mount a coup on the illegitimate govt?

    I’m glad that the Brazilian people are protesting so much. But the Supreme Court has already refused Bolsonaro’s plea. They were too hasty over it seeming to barely deliberate.

    (Reminded me of the US Supremes wit the 2020 fraudulent election)

    Which only compounds the massive problem. There are well over 200 mill people there.

    Mourão demands transparency from TSE

    Hamilton Mourão (Republicans), vice-president of the Republic, has charged more transparency from the Superior Electoral Court (TSE). Travelling to Portugal, he said that more guarantees are needed from the TSE that the elections took place normally. The statement was made on Wednesday 23.

    “It is not enough, pure and simple, laconic answers from our Superior Electoral Court in the sense of contesting eventual, let’s say, denunciations or arguments about the voting process,” the vice president commented. He added that the electoral court was “biased in this game”.

    Federal deputy Junio Amaral (PL-MG) criticised the decision of Minister Alexandre de Moraes, president of the Superior Electoral Court (TSE).

    The deputy classified the treatment given by Moraes to the party’s request as “ludicrous”. “I’m not even talking about the rejection of the request or the indifference to the facts presented, but the contempt with the facts, with the information contained in the report,” Amaral said in an interview with Jovem Pan radio’s Jornal da Manhã. “He didn’t even dwell on the report to give his opinion and to give his decisions.”

    “Similar things only happen in countries that are clearly dictators. There is not in a democracy what this gentleman is doing,” highlighted the deputy.
