Palestinians will Face ‘Tsunami’ of Legal Charges at Hague

Nitsana-Darshan-LeitnerShurat Hadin, a non-governmental organization that operates against Palestinian terrorists through the courts, said it would lodge ‘a tsunami’ of criminal complaints against senior Palestinians with the International Criminal Court (ICC), which is based in The Hague.

Following the signing of 15 international treaties by the Palestinian Authority (PA) in order to be accepted into UN organizations, and the PA’s ongoing threat to join the ICC, Shurat Hadin has begin preparing charges against senior PA officials for involvement in terror attacks.

In the documents to be filed to the ICC, Shurat Hadin’s lawyers will claim that the senior officials, including people from Hamas and Fatah, bear direct responsibility for terror strikes against Israel, which they abetted and encouraged.

In April of 2013, Shurat Hadin launched a campaign for collecting the names and details of hundreds of Israeli terror victims who could serve as complainants in the international courts. The group is now using that information to prepare the charges against the Palestinian officials.

Ever since the PA was accorded observer-state status in the UN last year, Palestinian leaders have been threatening Israel with the possibility that they will ask to be members of the ICC, in order to be able to file charges of war crimes agsint Israeli military officers and soldiers, as well as political leaders. They claim that the Jewish settlements in Judea and Samaria are illegal and constitute a breach of the Fourth Geneva Convention.

Shurat Hadin notes, however, that once an entity joins the ICC, that court’s powers can also be turned against it. Just as the Palestinians will be able to file charges against Israel, Israelis and non-Israelis who fell victim to Palestinian terror will be able to file charges against leaders of Hamas and Fatah.

Shurat Hadin says that the Palestinian leaders in Gaza, Judea and Samaria may well face “a tsunami of criminal complaints” regarding war crimes.

“Luckily, we knew what was coming, and over the past year we have been collecting testimony from terror victims in Israel, to serve as a basis for charges in the ICC,” said Shurat Hadin Chairperson, Attorney Nitzana Darshan-Leitner. “It was clear to us that besides launching a third intifada of violent terror, the Palestinians’ only real option was turning to the ICC against Israel.”

“We believe that these proposed charges are the only means of deterring the Palestinians who are in a hurry to join the ICC,” said the NGO. “At this stage, only non-governmental organizations like Shurat Hadin can take action againt senior PA officials in the ICC.”

    I totally agree with you. AH I think that now is the time to annex. These politicians do not love Israel. They are just interested in power. Harris a decision to annex and get it done. Then let the fireworks start with the EU first. The international community can complain, the US can complain but, once is done it is a fact. We can star fundraising to send them someplace far away from Israel. As long as we have them as neighbors there never will be peace.
    The phoenix you are right. I just don’t get it. Annexing it has to be done. I hope sooner rather than later.

  2. Rights are something taken and maintained by sovereign power backed up by armed force and the willingness to use it. The world is neither a courtroom issuing legally-enforceable judgements, nor a debating society.

    Just cut all the bullshit. Annex Shomron and Yehuda starting with all of Area C and connective parts of Area B, and start negotiating separate autonomy arrangements for the urban Arabs. If those Arabs want to vote in a country’s national elections plus get Medicare/Medicaid, Social Security public support for their children, assist them with one-way airline tickets to Dearborn, Michigan.

    Fortunately, the Arabs will never make solid peace with the Jews. Otherwise, some of your asshole leaders would give away Tel Aviv along with Jerusalem and haShem only knows what else.

  3. I don’t get it. Isn’t Israel a sovereign state? Weren’t these terrorist atrocities committed against Israelis, on Israeli soil by perpetrators within reach of Israel?

    So what business do we have going to the “ICC”. Are Israeli courts somehow deficient? Does Israel need the stamp of “legitimacy” afforded by the ICC? Is it a banana republic?

    We demean ourselves and set on ourselves double standards that no other nation is expected to adhere to and then wonder why the world imposes double standards on us and holds us in disdain.

    Well said. Of all those weak kneed and yellow livered politicians Darshan-Leitner , a woman, is the only one with cojones. She would make a better prime minister than any of the present challangers.

    I agree that the ICC is rigged in favor of legalizing the extermination of the Jews. Then let’s expose it. It could push Congress to stop all funding, likely with enough votes to override Obama’s certain veto.

    As for Shurat, they were quite effective in helping to stop another terrorist flotilla to Gaza a few years ago, although it was also stopped because Israel’s relations with both Greece and Cyprus had improved, and they were willing to not be dupes the second time around.

    B’TSELEM  , Breaking the Silence, and all other organizations that make accusations must be made to..EITHER SPEAK THE TRUTH OR PAY THE PRICE.

    Below is a e-mail that I sent to a group of rabbis . To date, I’ve gotten only 3 favorable responses. Text follows:

    On April 1, 2014 Itamar Barak of B’tselem released to the world media  very serious  specific charges against  IDF soldiers on the ground as well as against their commanding officers and the chain of command of the IDF.

    These allegations included unjustified killing from ambush of nonthreatening (innocent) Palestinians and inadequate investigation (cover up) by investigating officers and the IDF chain of command.

    If these allegations are correct then punishment is indeed in order.

    If  any of these allegations are not correct then  Itamar Barak, Jessica Montell, and the entire  B’tselem organization should be subject to strict legal penalties and to individual actions for defamation from those who have been accused falsely and from all of  of members  the same units that have been smeared by association.

    its not only about the money but it demonstrates a willingness to undertake and win a battle unlike the GOI.
    another step is to fund her seeking mandamus and estoppel against foreign govs who proclaim settlement illegal after having signed to the contrary in binding legal documents. also, seeking libel for the same “illegal settlement” statements. she is doing something where others do nothing. Adelson should give her the 100million she will get results for the money she recives in donations. I would like to see her grow this org to a size where she is inundating all the BDS including the stinking supersessionist lying churches. she is the only one getting results, the rest are BS.

  11. The person obtaining the judgement has the right to examine the debtor under oath as to his assets and their location. All assets can be seized and any receivable can be attached. Obviously the defendants will lie. Then if you can prove that they lied, that’s another crime. You can also look at their bank records and and I think their computers and maybe phone records.

    After brilliant debates proofs and whatever else you lawyers do, attorney Nitzana has received a positive verdict.
    The judge declared her to be the victor and thus the clients that she represents are entitled to a settlement of a gazillion dollars.
    The musloids, smirk and say you’re joking right? We have no intention whatsoever to pay a red cent.
    What happens next?
