The Mandate for Palestine

Israel must remain both strong and morally committed to Zionism, Judaism and the future of the State of Israel. This strength includes having the international legal basis for the State of Israel well known and asserted both in Israel and international forums.

Today, the international legal rights of Israel to Eretz Yisrael are now more important than ever owing to the Netanyahu Government’s plans to be more active in Judea and Samaria. Please note my recent introduction to my speech which I have been circulating lately:

The recent UN General Assembly Resolution declaring the founding of the State of Israel to be “unjust” is in no way permissible under international law!

UN General Assembly Resolutions are non-binding suggestions and do not constitute international law.

The League of Nations Mandate For Palestine is a treaty giving ONLY to the Jewish People national and political rights in the Land of Israel. It later was adopted by Article 80 of the UN Charter in 1946 and as a treaty and under Article 80 is far more weighty as an international agreement under international law than any nonsensical General Assembly Resolution.

The Mandate For Palestine should be brought front and center in the defense of Israel — and not forgotten about. It is a “cannon” to be used in the defense of Israel and not a “pea shooter” like the other arguments made in the legal defense of Israel.

Too many times the utterly false claim is made that “Israel illegally occupies Palestinian Land” — and our side does not have an appropriate legal response. This is a travesty and unnecessarily hurts Israel in the opinion of much of the world.

Below please find my 42 minute video presentation made on July 24, 2022, the 100th Anniversary of The League of Nations Mandate For Palestine, which I believe is very valuable and important for Israel’s government and diplomats, Israel advocates and university students to learn, master and repeat in order to respond to the 100% false claim that “Israel illegally occupies Palestinian Land.”

The truth is that this entire matter was resolved under international law 100 years ago by The League of Nations Mandate For Palestine unanimously adopted by 51 nations on July 24, 1922 which vested only in the Jewish People national and political rights to the Territory of Palestine (Eretz Yisrael).

Knowledge of The League of Nations (Not “British”) Mandate is very important in countering the lie when the Palestinians and their supporters say that “Israel illegally occupies Palestinian Land.’

Our side’s typical indirect responses that: “Israel is the only democracy in the Middle East. Israel gives Arabs full opportunities in the country. Israel is a high tech center. Israel helps Haiti earthquake victims” do not directly refute the lie that “Israel illegally occupies Palestinian Land.”

I very much would like you to watch this presentation and then to send it to others and those in the Israeli Government in order to counter the vile lies that Israel has no legal rights under international law to the Land of Israel.

  1. While this article is 100% correct in spirit, there is an issue out there that is always brought up to which Israel has no good answer: Why not go to the IJC and clear up the issue? The answer is quite simple: No matter wich arguments are brought before the court, BOTH sides get the opportunity to present their cases and the other side will always win. The very best Israel can hope for is a compromise, which is in reality a defeat.
